Scout — Terms of Service
Effective date: May 1, 2025
These Terms of Service ("Terms") are a binding agreement between you and
Scout, LLC ("Scout," "we," "us"), a Texas limited liability company located
In Austin, TX, governing your use of the Scout mobile application, our websites, and
related services (collectively, the "Service").
By creating an account, or by otherwise accessing or using the Service, you agree to
these Terms. If you do not agree, do not use the Service.
Our Privacy Policy is incorporated into these Terms by reference.
1. Eligibility and Age Requirements
You must be at least 13 years old to create a Scout account. Scout is an outdoor and hunting
activity app whose content includes depictions of hunting and harvested game; it is not directed
to children.
If you are under the age of majority where you live but at least 13, you may use the Service only
with the involvement and consent of a parent or legal guardian who agrees to be bound by
these Terms.
We do not knowingly collect personal information from anyone under 13. If we learn that we
have, we will delete the account and its data. To report an underage account, contact
support@scoutoutdoors.app.
By using the Service you represent that you are not barred from doing so under the laws of your
jurisdiction and are not on any applicable sanctions or denied-party list.
2. Your Account
Registration. Scout uses passwordless email sign-in. We send a one-time code to your email address; entering it signs you in. You are responsible for maintaining access to and control of that email account.
Accuracy. You agree to provide accurate registration information and to keep it current.
Responsibility. You are responsible for all activity that occurs under your account. Notify us at support@scoutoutdoors.app immediately if you believe your account has been accessed without your authorization.
One person, one account. Accounts are for individual human use. You may not sell, rent, or transfer your account.
3. Deleting Your Account
You may delete your Scout account at any time from within the app: Profile → Settings →Delete Account. You may also request deletion by emailing support@scoutoutdoors.app from your registered address, or at www.scoutoutdoors.app.
When you delete your account we permanently delete your profile, hunting records, photos,comments, likes, bookmarks, follows, dog profiles, and active hunt data, except where we are required to retain records by law or need limited data to resolve disputes or enforce our agreements. Deletion is irreversible. Content you posted that others have already saved,screenshotted, or shared outside the Service is outside our control.
4. Description of the Service
Scout lets you log hunts, capture and upload photos, use AI-assisted wildlife identification,optionally record your location and route, create dog profiles, and share posts with a social feed where others can follow, like, comment on, and mention you. We may add, change, suspend, or discontinue features at any time. We will use reasonable efforts to give notice of material changes that adversely affect you.
5. AI Wildlife Identification — Important Limitations
Scout uses third-party artificial intelligence models and computer vision providers (which may include OpenAI, Google, or other AI vendors) to suggest what species may appear in a photo you submit. These suggestions are automated estimates and are frequently wrong.
You agree that:
AI output is provided for informational purposes only and is not a verification of species, sex, age, legality, or edibility.
You are solely responsible for identifying your target before and after taking any game. Never rely on Scout to determine whether an animal is legal to harvest.
Scout is not a substitute for training, field experience, a licensed guide, or a wildlife expert.
Photos you submit to the identification feature are transmitted to third-party AI providers for processing. See our Privacy Policy for details.
6. Hunting Safety and Legal Compliance
Hunting and outdoor recreation are inherently dangerous activities that can result in serious injury or death. You use the Service at your own risk.
You are solely responsible for:
Obtaining and carrying all required licenses, tags, permits, and stamps.
Knowing and obeying all applicable federal, state, provincial, tribal, and local laws, including seasons, bag and possession limits, legal methods of take, tagging and reporting requirements, and firearm and archery regulations.
Obtaining permission before entering private land and avoiding trespass.
Safe handling, transport, and storage of firearms, ammunition, archery equipment, and knives.
Your own physical safety and that of your hunting companions and dogs.
Nothing in the Service is legal advice. Regulations change frequently and Scout may display outdated or incorrect information. Always confirm with the wildlife agency having jurisdiction. You agree not to use the Service to plan, coordinate, document, or promote poaching, trespass, illegal take, illegal wildlife trafficking, or any other unlawful activity.
7. Location Data
If you grant permission, Scout collects your device location to record hunt routes and tag posts. Scout can collect location in the background while a hunt is active, so that your route continues to record when the app is not on screen.
Background location collection occurs only while you have an active hunt in progress and only if you have granted the "Always" location permission.
You can revoke camera, photo, microphone, or location permissions at any time in your device settings. Some features will stop working if you do.
You control whether a post displays its location. While Scout provides features to help you protect private hunting and fishing spots, you are ultimately responsible for reviewing your post privacy settings prior to publishing. Be aware that publishing location can reveal sensitive information, including private property boundaries, hunting spots, and your movements. Do not share location if you do not want it seen.
8. User Content
"User Content" means anything you submit to the Service, including photos, captions, comments, species and harvest data, routes, dog profiles, and profile information.
8.1 You own your content
You retain all ownership rights in your User Content.
8.2 License you grant us
You grant Scout a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, cache, reproduce, adapt, resize, transcode, distribute, and display your User Content solely for the purposes of operating, providing, securing, and improving the Service and, where your content is public, displaying it to other users through the Service. This license ends when you delete the content or your account, except for copies retained in backups for a commercially reasonable period and content others have re-shared within the Service. You also grant other users a license to view and interact with your public User Content through the features the Service provides.
8.3 We are not obligated to store it. We do not guarantee that User Content will be retained or available. Keep your own copies of anything important to you. Uploads may fail, and photos captured in the app may not be preserved.
9. Prohibited Conduct and Objectionable Content
We have zero tolerance for objectionable content and abusive users. You may not post, upload, transmit, or otherwise make available content that:
Is unlawful, or depicts, facilitates, or promotes illegal activity, including poaching, illegal take, trespass, or wildlife trafficking;
Is sexually explicit, pornographic, or sexualizes minors in any way;
Depicts animal cruelty, torture, staged fighting, or the gratuitous suffering of animals, as distinct from lawful, ethical harvest;
Is gratuitously gory or shocking beyond what is inherent to documenting a lawful harvest;
Harasses, bullies, threatens, stalks, doxxes, or intimidates any person;
Constitutes hate speech or attacks or demeans a person or group on the basis of race, ethnicity, national origin, religion, disability, disease, age, sex, gender identity, or sexual orientation;
Promotes or glorifies self-harm, suicide, terrorism, or violent extremism;
Infringes any copyright, trademark, publicity, privacy, or other right;
Is false or deliberately misleading in a way likely to cause harm;
Contains malware, or is spam, chain solicitation, or bulk unsolicited promotion;
Impersonates any person or entity or misrepresents your affiliation.
You also may not:
Reverse engineer, decompile, or attempt to extract source code or credentials from the app, except where that restriction is prohibited by law;
Scrape, crawl, harvest, or bulk-download content or user data by any automated means;
Circumvent rate limits, access controls, or security features, or probe or test the vulnerability of our systems without written authorization;
Use the Service to build a competing product, or to train a machine learning model on content that is not yours;
Resell, sublicense, or commercially exploit the Service without our written permission (except for verified commercial guides, outfitters, and B2B partners operating under a separate, executed Partner Agreement with Scout);
Interfere with the Service's operation or place unreasonable load on our infrastructure.
10. Reporting, Blocking, and Moderation
Scout provides in-app tools to report any post, comment, or user, and to block any user.
Reporting is available on every piece of user-generated content.
We review reports of objectionable content and act on them within 24 hours of receipt, by removing the content, ejecting the user who provided it, or both.
Blocking a user immediately hides their content from you and prevents them from following you, commenting on your posts, or mentioning you.
You may also report content or users by emailing contact@scoutoutdoors.app.
We may remove content or suspend or terminate accounts at our discretion, with or without
notice, for violations of these Terms or where we believe removal is necessary to protect users,
comply with law, or protect Scout. We are not obligated to pre-screen content, and our failure to
act on a particular violation does not waive our right to act later.
If you believe we removed your content in error, contact support@scoutoutdoors.app to appeal.
11. Intellectual Property
The Service, including its software, design, text, graphics, logos, and the "Scout" name and
marks, is owned by Scout, LLC and its licensors and is protected by intellectual
property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable,
non-sublicensable, revocable license to install and use one copy of the Scout app on a device
you own or control, for your own personal, non-commercial use (provided that verified
commercial guides, outfitters, and retail partners may use the Service for commercial
promotional activities solely in accordance with a separate, written Partner Agreement or explicit
written authorization from Scout). All rights not expressly granted are reserved.
12. Copyright Complaints (DMCA)
If you believe content on Scout infringes your copyright, send a notice to our designated agent
at support@scoutoutdoors.app / Scout, LLC, Austin, TX including: (a) your physical or electronic
signature; (b) identification of the copyrighted work; (c) identification of the infringing material
and where it is located on the Service; (d) your contact information; (e) a statement that you
have a good-faith belief the use is not authorized; and (f) a statement, under penalty of perjury,
that the information is accurate and you are authorized to act on the owner's behalf.
We will respond to valid notices and will terminate repeat infringers' accounts.
13. Third-Party Services
The Service depends on third parties, including InstantDB (data storage and authentication),
third-party AI providers (including OpenAI and Google for species identification), Google Maps
(mapping and places), Expo (app delivery and updates), and Apple and Google (app distribution
and device services). Their handling of data is governed by their own terms and privacy policies.
We are not responsible for third-party services, and their availability or behavior may change
without notice.
14. Purchases and Subscriptions
The Service is currently offered free of charge, with optional premium subscriptions or features
planned. If you purchase paid features or subscriptions, they will be sold through the Apple App
Store or Google Play and billed by Apple or Google under their terms. Payment, renewal,
cancellation, and refunds for those purchases are handled by the applicable app store, and we
cannot issue refunds for store-billed purchases — you must request them from Apple or
Google. We will present the price, billing period, and renewal terms before any purchase and
will give notice before any price change.
15. Beta and Pre-Release Versions
Builds distributed through TestFlight, internal testing tracks, or otherwise identified as beta are
provided as-is for evaluation, may be unstable, and may lose or corrupt data. Do not rely on
beta builds for anything important.
16. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF
ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE
DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR
ERROR-FREE; THAT AI IDENTIFICATIONS, LOCATION DATA, MAPS, OR ROUTES WILL BE
ACCURATE; OR THAT CONTENT WILL BE PRESERVED OR RECOVERABLE.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may
not apply to you.
17. Assumption of Risk and Release
You acknowledge that hunting, shooting, hiking, boating, handling animals, and traveling in the
outdoors involve serious risks including injury and death, and that you assume those risks
voluntarily. To the fullest extent permitted by law, you release Scout, LLC and its
officers, members, employees, and agents from all claims arising out of your outdoor activities,
your reliance on any information in the Service, or your interactions with other users, whether
online or in person.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Scout, LLC AND ITS
SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST
DATA, LOST CONTENT, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF
OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL
NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS
BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS
($100).
These limitations apply regardless of the theory of liability and even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited, including for fraud or willful misconduct.
19. Indemnification
You agree to indemnify, defend, and hold harmless Scout, LLC and its officers, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Service, your violation of these Terms or applicable law, or your violation of any third party's rights.
20. Suspension and Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms, if required by law, or to protect the Service or its users. Sections 8.2, 11, 12, and 16 through 23 survive termination.
21. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution first. Before filing a claim, you agree to contact us at support@scoutoutdoors.app and attempt in good faith to resolve the dispute informally for at least 30 days.
Binding Individual Arbitration and Class Action Waiver. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally shall be settled by binding individual arbitration rather than in court, except that you or Scout may assert claims in small claims court if the claims qualify. YOU AND SCOUT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Venue. For any judicial proceeding permitted under these Terms, jurisdiction and venue shall lie exclusively in the state or federal courts located in Travis County, Texas.
22. Changes to These Terms
We may update these Terms. If a change is material, we will give at least 14 days' notice by in-app notice or email before it takes effect, and update the "Last updated" date. Continuing to use the Service after the effective date means you accept the new Terms. If you do not accept, you must stop using the Service.
23. General
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
Severability. If a provision is unenforceable, the rest remains in effect.
No waiver. Our failure to enforce a provision is not a waiver.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither party is liable for delays caused by events beyond its reasonable control.
Notices. We may send notices to your registered email or through the app.
24. Apple App Store — Additional Terms
These terms apply to the Scout app obtained from the Apple App Store and are required by Apple. In the event of a conflict, this section controls as to Apple only:
1. Acknowledgement. These Terms are between you and Scout, LLC only, not with Apple. Apple is not responsible for the app or its content.
2. Scope of license. Your license to use the app is a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Service, except that it may be accessed by other accounts via Family Sharing or volume purchasing.
3. Maintenance and support. Scout, LLC is solely responsible for maintenance and support. Apple has no obligation to furnish any maintenance or support services.
4. Warranty. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are the sole responsibility of Scout, LLC.
5. Product claims. Scout, LLC, not Apple, is responsible for addressing any claims relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual property claims. In the event of a third-party claim that the app or your use of it infringes that party's intellectual property rights, Scout, LLC, not Apple,is solely responsible for the investigation, defense, settlement, and discharge of that claim.
7. Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you as a third-party beneficiary.

25. Google Play — Additional Terms
For the Scout app obtained from Google Play, these Terms are between you and Scout, LLC only, not Google. Google is not responsible for the app or its content, is not a party to these Terms, and has no obligation to provide support. Your use is also subject to the Google Play Terms of Service.
